Correct. The ACA as presented to the SC was illegal. The government cannot force citizens to buy healthcare. So Roberts re-wrote the ACA (which is a tactic often used by liberal SC judges) to make it a tax. That would make it legal.
Scalia rightly ripped Roberts apart in his dissent, which was joined by Alito and Thomas.
As always, liberal judges see the the goal of the SC to rewrite laws into what they want them to be, originalist judges know the purpose of the SC is to INTERPRET the law, not create it.

Both are wrong. The penalty if a tax would actually be an income and a head tax. One is a legal tax on income and the other is a direct and illegal tax on individuals not based on income. Direct taxes are not authorized by the 16th amendment. They are authorized by the original document but ONLY via an apportioned tax on the states. I believe the states collect those . It was meant as a poison pill. ACA was just plain unconstitutional as written.
