They don't bump up to felonies unless those charges are included or attached. So far there's no felony for election law or income tax law which makes those specific charges a fishing expedition. But, Gatorspeed says there's more coming so we'll see.

Bragg didn't overcharge anything...he has 34 documents that prove the false business records charge.
The intent clause that's needed to make them felonies is documented by physical evidence...one example is the handwritten notes of the CFO Alan Weisselberg on a bank statement where he admitted the intention of tax fraud

You don't have to be successful in committing another crime (which is why it doesn't have to be charged)
Think of it this way
If you commit the misdemanor (lets say a theft) and plan to go on the run by buying a ticket to France (evasion) you would then face a felony theft even if you never got on the plane
