What you're saying is sort of based on fact. Depending on the state, theft of lost property is an actual crime.
However, in every state that I'm aware of, the original owner would need to file criminal charges and assist in prosecution. That essentially means that if the property is both lost and abandoned, it isn't a crime. If it's only one or the other, it likely is a potential crime.
