DOVER, Del. (AP) — A Delaware judge's ruling Friday set the stage for a dramatic springtime trial on whether Fox News bears financial responsibility for airing false allegations that a voting machine company rigged the 2020 presidential election against former President Donald Trump.

Superior Court Judge Eric Davis ruled that it was “CRYSTAL clear” that none of the allegations made by Trump allies on Fox in the weeks after the election were true.

Davis said it was up to a jury to decide whether Fox acted with actual malice in airing the claims and, if so, how much money Dominion is entitled to in damages. Dominion has sued Fox for $1.6 billion.

Barring a last-minute settlement, the trial is expected to begin in mid-April.

“The statements at issue were dramatically different than the truth,” Davis said in a summary judgment ruling, which denied Fox's effort to throw out the case as well as Dominion's request for a victory without a jury. “In fact, although it cannot be attributed directly to Fox's statements, it is noteworthy that some Americans still believe the election was rigged.”

Fox's failure to reveal extensive evidence contradicting the fraud claims “indicates that its reporting was not disinterested,” the judge wrote.

Ex-Fox producer files new claims lawyers coached her testimony in Dominion lawsuit

The former Tucker Carlson producer who sued Fox News last week alleging she was pressured into giving misleading testimony about the network’s coverage of supposed election fraud has filed new allegations about coercive coaching by Fox lawyers, bias and unprofessional behavior by staff members, and retaliation by the network.

In papers filed Monday morning, Abby Grossberg seeks to correct the Sept. 14 deposition she gave about the network’s coverage of Dominion Voting Systems, which she says was tainted by pressure from Fox lawyers. Grossberg alleges she was not able to see a transcript of her testimony before it was made part of the record, even though she requested a chance to see it six times, while male colleagues were allowed to see their transcripts. She says she was able to review and correct it only more than five months later, after she retained her own attorneys.

“Based on what I understood and took away from the deposition preparation sessions I had with Fox’s legal team which were coercive and intimidating,” Grossberg said in an unredacted errata sheet filed in Delaware, “I felt that I had to do everything possible to avoid becoming the ‘star witness’ for Dominion or else I would be seriously jeopardizing my career at Fox News and would be subjected to worse terms and conditions of employment than male employees as I understood it.”

Fox News Anchor Finally Allowed To Discuss Dominion Lawsuit On Air

Fox News anchor Howard Kurtz on Sunday finally weighed in on the $1.6 billion defamation lawsuit brought by Dominion Voting Systems against his employer.

Kurtz had previously said he “strongly” disagreed with the conservative network’s decision not to allow him to report or write about the case given that he is part of the organization being sued.

But that changed this weekend.

“Now that all the legal filings are in and a judge in Delaware will give consideration this month to whether the case goes to trial, it’s time for me to weigh in,” Kurtz said.

During a four-minute segment on his “MediaBuzz” show, Kurtz said he wasn’t “sugarcoating” Dominion’s allegations “or the fact that Fox has taken a hit in the court of public opinion.”

Dominion Voting Systems on Friday not only beat back Fox News' attempt to skip a defamation trial, it won a summary judgment for some of its claims.


Why it matters:
This gives Dominion a head start in trial. A Delaware judge found that it's "CRYSTAL clear" (original emphasis) that Fox News' statements about Dominion are false — making it an issue that won't be disputed at trial.

NEW YORK (AP) — Fox News agreed Wednesday to hand over thousands of documents to voting machine company Smartmatic, which is suing the network for defamation in a case similar to Dominion Voting Machines' just-settled lawsuit.

Smartmatic says Fox bears financial responsibility for airing false allegations that the company rigged the 2020 presidential election against former President Donald Trump.


Last week, Fox agreed to pay Dominion nearly $800 million to avert a trial, although the ultimate cost to the media company is likely to be much lower.

Smartmatic wants a $2.7 billion judgment, which far exceeds the $1.6 billion Dominion sought in its suit. No date has been set, and the case might not go to court for a couple of years.

Smartmatic said in court filings that Fox “slow-rolled its production” of transcripts and other material that were created during the Dominion suit, and that Smartmatic had received just a small fraction of the more than 52,000 documents it requested as part of the discovery process.

Among the documents Smartmatic hopes will bolster its case are deposition transcripts for Fox founder Rupert Murdoch and his son Lachlan Murdoch, as well as documents related to company executive Raj Shah and lawyer Viet Dinh.

Fox News to hand over additional documents in Smartmatic case

Fox News has agreed to provide additional documents and legal materials from the recent case it settled with Dominion Voting Systems to Smartmatic, a second voting systems company that is suing the network for defamation.

“We will produce the materials as quickly as we are able to,” Fox lawyer Winn Allen said during a hearing in New York, CNN reported.

Smartmatic is seeking more than $2 billion from Fox, accusing it of maliciously giving Trump lawyers Sidney Powell and Rudy Giuliani a platform to air false claims about the 2020 presidential election and its software.

Fox last week agreed to pay $787.5 million to settle the defamation case brought by Dominion, one of the largest payouts by a media company to a plaintiff ever.


A trial in the Smartmatic case is likely months or years away, but Fox lost its first bid to toss the company’s suit, allowing it to move onto discovery.
