The special counsel investigating Donald Trump has new emails, letters and other documents from election officials in battleground states, as the federal probe accelerates into whether the former president should face criminal charges for efforts to overturn the 2020 election.
Two years after the US Capitol attack and with the 2024 election cycle looming, Special Counsel Jack Smith and his team of Justice Department prosecutors are combing through new testimony and evidence. He’s set to make critical decisions about whether to bring charges, possibly in a matter of weeks, according to people familiar with the matter.
Officials in several states confirmed they have complied with an early round of grand jury subpoenas from Smith’s office. One set of material reviewed by Bloomberg from a key battleground in Nevada shows Trump’s 2020 campaign representatives lobbing accusations of fraud and mismanagement at local officials in the days after the election.
Attorneys working under Smith are also poring over dozens of interview transcripts from the congressional panel that just wrapped up its own Jan. 6 probe, said people familiar with the investigation, who asked not to be named to discuss information not yet public. That includes testimony from White House aides who said Trump knew he lost the election and at least one Republican official who linked the former president to efforts to seat alternate slates of electors in some states he lost.

WASHINGTON — A federal judge on Thursday ordered former Donald Trump aide Peter Navarro to hand the National Archives 200 to 250 emails that he sent during his time in the Trump administration using a private email account instead of his White House email.
In August 2022, the Department of Justice filed a civil lawsuit against Navarro to compel him to hand over the emails after he refused to do so without first being granted immunity. Lawyers for Navarro alleged the Justice Department was using the Presidential Records Act, which requires that official White House records be preserved, as a way to gather evidence against him in his ongoing criminal contempt of Congress case. When the Department of Justice took the position this week that former President Donald Trump acted improperly by urging his followers to attack Congress in 2021, prosecutors did more than open the door to a potential flood of civil lawsuits from police officers who were injured on Jan. 6.
What they actually did, according to legal scholars, is lay the groundwork for a potential criminal indictment against Trump for inciting the insurrection.
“If they took the position that the president was absolutely immune, then they wouldn’t be able to bring a criminal prosecution,” said one person familiar with the DOJ’s ongoing investigation who spoke on condition of anonymity.
Legal scholars have come to the same conclusion.
“Had DOJ concluded that incitement unprotected by the First Amendment could nevertheless be within the president’s official functions, that could conceivably have impacted criminal charging decisions related to the same speech,” said Mary B. McCord, a former federal prosecutor now teaching at Georgetown University Law Center.
