Actually, my opinion is supported by a lot of fact and witness testimony. How many pages of the 86 page TPD report have you read? How many pages of the 248 page State's Attorney report have you read?

- Did Erica Kinsman tell various versions of her story? Yes. Fact. This can be verified by reading the aforementioned reports and was also confirmed by Justice Harding.

- Was Erica Kinsman drunk and/or black out as she stated in her report(s)? No. Fact. Confirmed by her .048 alchol level AND her friend's testimony (Monique Kessler and Marcus Jordan).

*Pg 12/248, [Erica's friend] Monique said she and XX continued to drink a little more but never got to a level where she felt they were intoxicated. She said XX did not seem drunk and said "we all seemed fine."

*Pg 13/248, [Erica's friend] Marcus said, she did not drink a lot and is not a "huge drink girl."

- Did Erica Kinsman sustain head trauma from being hit over the head at a party and subsequently blacking out? No. Fact.

*Pg 32/248, "According to Bria, she called Erica after Erica sent her a text to please call her. Erica told her that she was at a party and got hit on the head and blacked out when the incident occurred."

Furthermore, was Erica's friend Monique asked by Patricia Carroll to lie about who owned the clothes worn by Erica on the night of the alleged sexual encounter? Yes.

Pg 14/248 - On 12/4/13, FDLE confirmed the unknown foreign DNA located in XX's pink pants was that of Jamal Roberts. Christopher Casher was excluded from any foreign DNA in this case. The blood that was sent to FDLE and Dr. Bruce Goldberger was also confirmed to be XX's blood. It is also noted in a report dated 11/22/13 that both Marcus Jordan and Ronald Darby were elin1inated as possible donors of the unknown foreign DNA in the pink pants. I then contacted Monique to inquire about her borrowing XX's clothes. Monique said she did not specifically recall ever wearing any of XX' s clothes. She said she may have tried her clothes on but did not remember wearing any of XX' s clothes when they went out. I asked Monique if she recalled having sex prior to trying on any of XX' s clothes. I also asked her if she could remember specifically wearing or trying on the pink pants worn by XX the evening of the incident.

Monique indicated [Erica] asked her the same question recently. I asked Monique when she spoke to XX about the clothing issue and she reluctantly said a day or two prior to 11/25/13. It should be noted that Monique is 5' 8" and [Erica] is 5' 5" tall.

The list of discrepancies goes on and on and on. Heck, she release/told a completely new story at the Student Code of Contact Hearing.

I don't know the specifics of the AC situation, but I don't follow your "don't put yourself in the position to be accused"

So college kids aren't suppose to date?

It's really easy to be accused in the most innocent positions.

You mean the new story at the COC Hearing where for the first time ever, she said it was Jameis himself who gave her a shot?? Before that it was an unknown male, or an Indian looking male, but magically for the COC it turned into Jameis Winston. Then she told Justice Harding that she left with the players because she was afraid of the consequences of not getting into the cab with them, although she admitted they did nothing whatsoever to make her feel afraid. This Winston case is a 100% sham and if it wasn't for the dislike of Winston, she would have been called out long ago.

@sadgator is way off on this one. You can not just kick kids off a team for accusations and no proof of the wrong doing. If that is the trend we start setting then more false accusations will be made by fans who hate the Gators. Come on SadGator be real buddy

serious deal and the bad PR for UF is far beyond shooting a bb gun or barking at a police dog. This is especially true given the current climate set by programs like FSU and Baylor. As a player with AC's level of talent and exposure you just have to know better.

UF screwed up the hearing officer appointment and is now getting bbqed over it. And AC has been suspended since January. All of that isn't happening just because of a purely fabricated event. Something happened and AC is directly responsible for the position he put himself in.

The lesson is, choose your partners wisely or put yourself at risk. And when it gets to this point...you have nobody to blame but yourself.

No one player is worth that kind of stink on your program. And since we will never know the truth, regardless of the outcome of any admin hearing, this is where sadgator draws his line.

Treon was accused of attempted sexual assault, not "true rape" whatever that is. This is the second time in a year that he's been formally accused of sexual misconduct. And whatever he did this time, it at least merited his leaving school and/or being told to get lost.

BTW, sexual assault could be something as simple as a guy yelling "hey sugar t*ts" to a girl. And with universities overzealously pushing this campus rape narrative, even though the facts don't support it, you get all these women being 'sexually assaulted' because they're taught if they have a night of regret its prosecutable. Well, actually its not. Only in these kangaroo courts called student conduct committees where there is no due process can these ridiculous claims be given any weight. And the accuser doesn't even have to show. That's justice if I've ever seen it.

A Florida state attorney did not see enough evidence to pursue charges of sexual misconduct brought forth by a female student at the University of Florida against Gators wideout Antonio Callaway and former quarterback Treon Harris in December 2015, according to an ESPN report.



After consulting with university police, state's attorney William Cervone refused to go further after the incident was not reported to the university or Gainesville police department.



"I had a conversation with officers at the university to see whether it was going to come this way," Cervone said to ESPN. "Based on what I knew then, I didn't think there was even a remote possibility of criminal charges. It would have been totally un-prosecutable based on the facts given to me. It would have never risen to sexual assault or sexual battery."



The female accuser boycotted Callaway's Title IX hearing last week, according to ESPN, after a Florida booster was appointed to adjudicate the case. Sources tell ESPN that Callaway's accuser did not attend his hearing.

Callaway hasn't been reinstated by the university, but his suspension's been modified to allow him on campus. He has not rejoined Florida's football team.

Back to the matter at hand, Callaway is still in limbo. Practicing, but the CoC hearing has not been held.
 
If this were a criminal case would the judge, faced with the same "potential bias" recuse himself? How about a lawyer?

I agree that the optics of this are terrible. And UF should probably capitulate. But it is not like this kind of thing is unprecedented.

Not gonna drag you through all of the similarities and differences between Judges, Neutrals(arbitrators & mediators), and lawyers as it relates to conflicts of interest. In each of those roles, individuals may, and commonly do recuse themselves or do not accept an assignment. They can also be forced out of their role.

When your school has set the bottom standard for poor handling of a rape allegation, it really shouldn't be all that surprising that it gets mentioned when people are discussing another school handling a sexual misconduct allegation.
