The Justice Department has convinced a federal judge that former President Donald Trump used one of his defense attorneys in furtherance of a crime or fraud related to the existence of classified documents at Mar-a-Lago, sources familiar with the matter told CNN.

The finding – part of a major ruling Friday from Judge Beryl Howell of the DC District Court – makes clear for the first time that the Justice Department is arguing it has evidence that Trump may have committed a crime. And Howell ruled that prosecutors met the burden to overcome Trump’s right to shield discussions with his lawyers normally protected under attorney-client privilege.

The evidence would likely be significant in the obstruction probe being pursued by special counsel Jack Smith’s team. It also underscores how critical the testimony of Trump’s defense lawyers would be in the federal grand jury investigation.


Judges Nina Pillard, Michelle Childs and Florence Pan of the DC Circuit have demanded more information and arguments by early Wednesday morning, setting a deadline for Trump and his lawyers by midnight and for prosecutors to respond by 6 a.m.

The extremely tight deadlines – a turnaround essentially unheard of in this court – indicates the seriousness of the matter.

The DC Circuit judges also mention documents involved in the dispute, asking that Trump’s side “specify” them. The court order doesn’t explain any further what’s happened with documents. But Corcoran also was ordered to hand over a number of documents, including handwritten notes and notes transcribed of a verbal conversation.
 
I don't have to read the article the title alone is pretty telling.

They convinced a judge to give them the search warrant and they took this long to find some evidence of wrongdoing? That means it was a bad warrant or a fishing expedition.

I'll be back to apologize when they charge him with something. With anything. Right now it has all the appearances of grasping at straws.

The Fulton County District Attorney’s office said some fake electors for Donald Trump have implicated each other in potential criminal activity and is seeking to disqualify their lawyer, according to a new court filing.

The district attorney’s office is requesting that attorney Kimberly Bourroughs Debrow be disqualified from representing a group of 10 Republicans who served as electors for the former president in Georgia – a state Trump lost to President Joe Biden. The DA’s office also accused the lawyer of failing to present an immunity deal to her clients last year, according to the filing.

The new filing offers the latest indication that immunity offers could still be in the works months after Fulton County District Attorney Fani Willis suggested charging decisions were “imminent.”

Former President Donald Trump’s advisers are so furious over departing defense attorney Tim Parlatore’s recent CNN interview—an interview they feel potentially implicated them in a Mar-a-Lago classified documents case coverup—that they are now trying to ruin Parlatore’s reputation, according to two sources briefed on the situation.

So upset is the Trump team, one of the sources said, that his lawyers have floated the idea of suing Parlatore or filing a bar complaint to mar his professional credentials.

“He basically called into question the legal team’s ethical guidelines,” this source said. “So everyone who stayed…he put everyone in a very bad position.”

After Parlatore left the legal team defending the former president against Department of Justice Special Counsel Jack Smith last month, he then appeared opposite CNN reporter Paula Reid on May 20. During that interview, Parlatore revealed that internal legal squabbles prompted his departure. But one particular disclosure during the interview irked Trump’s advisers more than any other: Parlatore said Trump’s right-hand legal and public affairs guy, Boris Epshteyn, used his authority to run interference and halt legal cooperation with the feds.

As Trump’s legal troubles keep growing—with criminal and civil investigations in New York City, Washington, and Atlanta—so too does the unwieldy band of attorneys who simply can’t get along.

The cast of characters includes an accused meddler who has Trump’s ear, a young attorney who lawyers on the team suggested is only there because the former president likes the way she looks, and a celebrity lawyer who’s increasingly viewed with disdain. Twice-impeached, once-indicted former president Donald Trump has lost yet another lawyer who was set to defend him in his pile of legal woes, but Alex Wagner isn’t too shocked. According to the MSNBC host, Trump’s legal team is basically just playing one big game of “not it” at this point.

Earlier this month, Timothy Parlatore, one of the attorneys defending Trump during the Justice Department’s ongoing investigations into the former president’s handling of classified documents, confirmed that he was exiting Trump’s legal team, apparently due to general infighting among the attorneys.

Wagner was quick to point out on Tuesday night that Parlatore is now at least the seventh former Trump attorney to either testify to Jack Smith’s grand jury or speak to investigators directly, signaling that “it seems like these attorneys are starting to get worried about going down with the ship.”


Wagner also highlighted new reporting from The Guardian that says Parlatore was specifically waved off by his colleagues when he attempted to search Trump’s Mar-a-Lago office for more documents, which of course, ended up being where more documents were eventually found.

The turmoil inside the legal team only exploded into public view when one of the top lawyers, Tim Parlatore, abruptly resigned two weeks ago from the representation citing irreconcilable differences with Trump’s senior adviser and in-house counsel Boris Epshteyn.

But the departure of Parlatore was the culmination of months of simmering tensions that continue to threaten the effectiveness of the legal team at a crucial time – as federal prosecutors weigh criminal charges – in part because the interpersonal conflicts remain largely unresolved.

It also comes as multiple Trump lawyers are embroiled in numerous criminal investigations targeting the former president: Epshteyn was recently interviewed by the special counsel, while Parlatore and Trump lawyer Evan Corcoran testified to the grand jury in the classified documents inquiry.

Former President Donald Trump’s legal woes go beyond the dozens of state and federal charges against him — he’s having trouble finding qualified lawyers willing to help him wage his various courtroom battles.

With his history of ignoring legal advice and his bills, it’s not hard to see why.

On Friday, attorney Jim Trusty submitted a request to withdraw from Trump’s defamation suit against CNN, citing “irreconcilable differences” with his client.

The move came just one week after Trusty and another lawyer, John Rowley, decided to resign from Trump’s legal team in the matter of classified documents he is accused of illegally storing at his Mar-a-Lago resort.

In January of this year, the State Bar of California announced the filing of a Notice of Disciplinary Charges against attorney John Eastman, precipitated by his central role in the scheme devised by Donald Trump and his allies in several swing states to create and submit fraudulent election certificates and the now-infamous slates of "fake electors."

Eastman's plot to subvert the 2020 election and defraud millions of American voters will almost certainly be central to the next two indictments facing Trump, those being conspiracy charges likely to be filed this summer by prosecutor Fani Willis in Georgia and special counsel Jack Smith in Washington, D.C.

Like so many other attorneys, advisers and aides who have fallen under Trump's spell and done his bidding, Eastman must now face the consequences of his actions. Last week his trial before the California Bar Court began in Los Angeles, with prosecutor Duncan Carling arguing that Eastman should be disbarred as "the architect of a legal strategy aimed at keeping former President Donald Trump in power, [who had] concocted a baseless theory and made false claims of fraud in an attempt to overturn the 2020 election."

Bloomberg) -- Rudy Giuliani was ordered to pay the attorney fees of two Georgia election workers suing him for defamation, after a judge found he failed to comply with his obligations to turn over evidence in the case.

US District Judge Beryl Howell entered an order on Friday directing Giuliani to cover what it cost the lawyers for Ruby Freeman and her daughter Wandrea “Shaye” Moss to pursue their successful motion to compel him to produce information.

The order doesn’t specify the amount he’ll owe; the judge directed the plaintiffs to disclose that in a later filing. Howell wrote that Giuliani had failed to show that his resistance to the plaintiffs’ discovery requests was “substantially justified,” which meant he was required to pay their attorney fees.

Freeman and Moss became the subject of 2020 post-election voter fraud conspiracy theories that Giuliani, former President Donald Trump, and other Trump allies promoted. Earlier this week, the Georgia State Election Board announced it had formally cleared Freeman and Moss of any wrongdoing.

Freeman and Moss had sued Giuliani in federal district court in Washington in December 2021. In recent months, their attorneys had argued to Howell that Giuliani was dragging his feet in turning over evidence and had failed to perform adequate searches.

As the Justice Department's investigation into former President Donald Trump's role in overturning the 2020 election advances swiftly, prosecutors are examining the role his allies played in pushing out false claims about election fraud, including plans to assemble "fake electors" in key swing states that were won by President Joe Biden, according to The New York Times.

Federal prosecutors last week interviewed Trump's former personal lawyer Rudy Giuliani, who actively promoted baseless legal theories challenging the presidential election results, individuals familiar with the matter told The Times.

Trump's legal team also filed lawsuits in key states, asserting unsubstantiated allegations of extensive election fraud, despite statements from officials, including Trump's own Attorney General William Barr, who confirmed that there was no evidence of widespread voter fraud.

"Trump's lawyers can be charged with conspiring to overturn the election results," former federal prosecutor Neama Rahmani told Salon. "There is legal advocacy on behalf of a client and there is criminal conduct in coordination with a defendant, and Trump's lawyers may have crossed that line."

Attorneys who aided in Donald Trump’s efforts to reverse the results of the 2020 presidential election have reportedly come under increasing scrutiny from the office of Special counsel Jack Smith.

Prosecutors from Smith’s team have interviewed Trump’s one-time personal lawyer Rudy Giuliani for about eight hours; issued inquiries centered on Sidney Powell, a pro-Trump lawyer who spread election misinformation; and questioned Brad Raffensperger, the Georgia secretary of state, about Giuliani, the Wall Street Journal reported Monday.

Smith has been tasked with leading Justice Department inquiries into Trump’s treatment of classified documents and his role inspiring the deadly Jan. 6 attack on the Capitol. The classified documents probe produced a 37-count indictment against Trump in Florida last month.

Last year, a federal judge in California said Trump’s effort to reverse his presidential election loss likely amounted to a crime.
