The obvious problem is they didn't test the phone for his DNA. He said he never threw the alleged victim's phone. If DNA was tested and present his credibility is instantly in doubt.

Definitely would not make him a rapist, but would certainly warrant further investigation. Do prostitutes offer their services for free food? I don't know, but he admitted that he said he would 'take care' of her during the initial negotiation.

"On 07/26/11, I met with ASA Jack Campbell. We reviewed the case and he
advised unless the suspect's DNA came back from the phone, there was not
enough supportive evidence to prosecute for Sexual Battery, because he
denied throwing her phone out or ever touching it."

Therefore:

1) It appears that the police were under the impression that if McCallister's DNA was on the phone, then the SAO would likely bring charges and prosecute.

2) TPD didn't send the DNA kit for nearly three years.

3) After almost three years, there was no recoverable DBA on the phone. Evidence was destroyed- evidence that it appears would have either resulted in charges against McCallister (if his DNA was on the phone), or resulted in the final closing of the case (if McCallister's DNA was not there).

So TPD's actions caused the destruction of what appeared to be the pivotal evidence in the SAO's decision. Which leaves only the question of intent.

Did TPD do it on purpose, or was it incompetence? That is arguable- but given the grievous failures in the TPD's Winston investigation, it is natural for the question to be asked.

I don't think the TPD is particularly well run, but I don't think police departments are well run generally. They're beurocratic nightmares with significant resource constraints. They probably didn't send the sample because it costs thousands of dollars to process DNA and the woman was on crack and changed her story multiple times. I'm sure the only reason they followed up on the case was because they were feeling pressure from the Jameis coverage. I don't like that police departments make those kind of decisions, but they do.

1) If that is a shot at GPD, I believe they are mildly better than TPD at actually enforcing the law against football players. But the Gainesville State Attorney's Office is very lax in prosecutions. Tallahassee SAO seems to be mildly better than Gainesville in that regard. Gainesville, like Tallahassee, has a problem with law enforcement coddling football players- it is just centered at a different level of the justice system.
