WASHINGTON (Reuters) -U.S. Supreme Court Chief Justice John Roberts will not testify at an upcoming Senate Judiciary Committee hearing expected to focus on judicial ethics, he said in a letter on Tuesday to the committee chair.

The committee's Democratic chairman, Dick Durbin, had asked the chief justice to appear before the panel to address potential reforms to ethics rules governing the justices. The senator cited "a steady stream of revelations regarding justices falling short of the ethical standards."

Roberts said he would "respectfully decline" the invitation, adding that such appearances by chief justices were exceedingly rare given concerns about the separation of powers between the three branches of the U.S. government.


A Supreme Court spokesperson issued the response, which included five pages of information about current judicial ethics standards.

Durbin had earlier asked Roberts to investigate ties between Justice Clarence Thomas and a wealthy Republican donor.
 
That makes him a smart Justice. Stay the heck away from any thing having to do with Congress. It's a lose lose to appear.

Following revelations of undisclosed gifts and real estate sales involving two Supreme Court justices, a pair of senators introduced bipartisan legislation to require a new code of conduct for the nine-member court.

Sens. Angus King (I-ME) and Lisa Murkowski (R-AK) are supporting the "Supreme Court Code of Conduct Act," which would compel the high court to form an ethics code and appoint an official to review complaints or potential conflicts of interest, according to a press release.

“The American public’s confidence in the Supreme Court is at an all-time low. Americans have made clear their concerns with the transparency — or lack thereof — coming from the Supreme Court and its justices,” Murkowski said.

Murkowski added that any "cracks" in the public's confidence could be damaging to the nation's democracy.
