Depends on the state but taking lost property is usually considered theft. In Alabama it's literally called Theft of Lost Property.
Abandoned is a legal term that has to meet certain requirements. I'd have a hard time believing that a diary, one that you know belongs to a certain person, could be considered abandoned.
