I'm not going to pretend like I know the legalities involved here, I don't. But I do know right and wrong.
These schools should take the settlement money out of their General athletic funds if need be and do the right thing by paying these families.
If you're able to recoup it later via insurance, the state or whatever - that's fine. If not, eat the cost. Regardless, do what's right here and give them the money they are owed.
