You don't prosecute someone you suspect of breaking the law. You investigate them, gather evidence, make a case and then you prosecute them.

One of the laziest Marines I know who lateral moved to the intelligence field is now working for a think tank in Washington as a civilian analyst or other something says it's stuff we'd rather the public not know about but in his opinion as an analyst not illegal or anything they haven't been doing.
That's purely anecdotal BTW. Intel and Air Wing are the fields I had the least exposure to. Every company has an S-2 shop so I know we had Intel at both units I was with. But they weren't at the maintenance facility or in the field so I never ran into them. The only pencil pushers I interacted with were supply and the admin section about my constant pay problems.
