Can NIL eliminate counters and scholarship limits?

Can a school tell a recruit that he won't be on scholarship but will get NIL deals worth over how much tuition, stipend, meals etc. a scholarship player gets? Or do they have to be a scholarship player to be eligible for NIL deals? If it is the former one, it could potentially create an environment where initial counters and 85 scholarship limits won't matter as long as school have the funds to pay for more scholarships via NIL.
