The charity, the Supreme Court Historical Society, is ostensibly independent of the judicial branch of government, but in reality the two are inextricably intertwined. The charity’s stated mission is straightforward: to preserve the court’s history and educate the public about the court’s importance in American life. But over the years the society has also become a vehicle for those seeking access to nine of the most reclusive and powerful people in the nation. The justices attend the society’s annual black-tie dinner soirees, where they mingle with donors and thank them for their generosity, and serve as masters of ceremonies to more regular society-sponsored lectures or reenactments of famous cases.

The society has raised more than $23 million over the past two decades. Because of its nonprofit status, it does not have to publicly disclose its donors — and declined when asked to do so. But The New York Times was able to identify the sources behind more than $10.7 million raised since 2003, the first year for which relevant records were available.

At least $6.4 million — or 60% — came from corporations, special interest groups, or lawyers and firms that argued cases before the court, according to an analysis of archived historical society newsletters and publicly available records that detail grants given to the society by foundations. Of that, at least $4.7 million came from individuals or entities in years when they had a pending interest in a federal court case on appeal or at the high court, records show.

The donors include corporations like Chevron, which gave while embroiled in a 2021 Supreme Court case involving efforts by cities to hold the oil company accountable for its role in global warming. Veteran Supreme Court litigators gave while representing clients before the court that included Tyson Foods and the Ministry of Commerce of the People’s Republic of China.

IN LATE JUNE 2019, right after the U.S. Supreme Court released its final opinion of the term, Justice Clarence Thomas boarded a large private jet headed to Indonesia. He and his wife were going on vacation: nine days of island-hopping in a volcanic archipelago on a superyacht staffed by a coterie of attendants and a private chef.

If Thomas had chartered the plane and the 162-foot yacht himself, the total cost of the trip could have exceeded $500,000. Fortunately for him, that wasn’t necessary: He was on vacation with real estate magnate and Republican megadonor Harlan Crow, who owned the jet — and the yacht, too.

For more than two decades, Thomas has accepted luxury trips virtually every year from the Dallas businessman without disclosing them, documents and interviews show. A public servant who has a salary of $285,000, he has vacationed on Crow’s superyacht around the globe. He flies on Crow’s Bombardier Global 5000 jet. He has gone with Crow to the Bohemian Grove, the exclusive California all-male retreat, and to Crow’s sprawling ranch in East Texas. And Thomas typically spends about a week every summer at Crow’s private resort in the Adirondacks.

The extent and frequency of Crow’s apparent gifts to Thomas have no known precedent in the modern history of the U.S. Supreme Court.

Senate Democrats call on Chief Justice Roberts to investigate Thomas' undisclosed trips


Senate Democrats are calling for Supreme Court Chief Justice John Roberts to investigate the findings of a recent media report that detailed extravagant undisclosed trips taken by Justice Clarence Thomas that were paid for by a conservative billionaire.

Senate Judiciary Committee Chair Dick Durbin, D-Ill., and the 10 other Democrats on the panel said in a letter Monday that Roberts had a responsibility to look into a ProPublica article published Thursday that said GOP donor Harlan Crow had for years funded lavish trips for Thomas, one of the court's most conservative justices.

"We urge you to immediately open such an investigation and take all needed action to prevent further misconduct," the senators wrote.

The panel said that it plans to hold a hearing on the “need to restore confidence in the Supreme Court’s ethical standards" and that it would consider legislation to resolve those concerns.

Newly obtained records show how Leonard Leo, an architect of the right-wing takeover of the courts, has been funding groups pushing to change elections and anti-discrimination laws.

Flush with money after receiving the largest-known political advocacy donation in U.S. history, conservative activist Leonard Leo and his associates are spending millions of dollars to influence some of the Supreme Court’s most consequential recent cases, newly released tax documents obtained by ProPublica and The Lever show.

The documents detail how Leo, who helped build the Supreme Court’s conservative majority as an adviser to President Donald Trump, has used a sprawling network of opaque nonprofits to fund groups advocating for ending affirmative action, rolling back anti-discrimination protections and allowing state legislatures unreviewable oversight of federal elections.

The records also show that the Leo-aligned nonprofits paid millions of dollars to for-profit entities connected to Leo.

Leo and one of his top associates did not respond to requests for comment.

The money flowed mostly through so-called dark money groups, which don’t have to disclose their donors. They are required to reveal the recipients of their spending in their annual tax returns, which are released to the public, but often those are also dark money groups or other entities that have minimal disclosure rules.
